The State of Alaska is currently considering the adoption of the new FRCP
26 (Discovery and duty of disclosure), but is concerned about the
ambiguity of the language in 26(a)(1)(A), "relevant to disputed facts
alleged with particularity in the pleadings."
We have exhausted conventional resources and now seek your assistance in
obtaining the names of contact persons. Are any of your professors
currently working on this? Are you aware of other jurisdictions
struggling with this issue? Has your firm recently briefed this new
rule? Any leads you can provide are greatly appreciated.
