A patron is researching a 1972 California case which challenged testing of
students since a disproportional number of minority students were placed in
special education classes due to test results. (Larry P. v. Riles, 343 FSupp
1306, ND Cal. 1972).
I was able to find the statutes cited to in the case, but the patron would also
like the related regulations. The citation in the 1969 volume of Wests
California Stat. Ann is 5 Cal Admin. Code ss180 et seq. Apparently these
regs had disappeared in the 76-77 version of the regs.
If anyone has these old regs in their library (I assume the case dates from
sometime in 1970-71 since the statute cited was passed and became effective in
Oct. 1971, -- it is the Education Code section 6902.085) I would love to hear
from you. This is not a big rush and I will be out of the office Friday, 2/3
and over the weekend. If you have these sections, call or leave me a message,
