. I was able to locate several EEOC decisions which indicate that sleep
. apnea is considered a disability under the Rehabilitation Act of 1973.
. Two of these are: Stokes v. Federal Communications Commission, EEOC
. request no. 01932472 dated 2/8/94, and Michelson v. Dept of Defense Army
. and Air Force Exchange, EEOC request no. 01912154 dated 11/25/91. You can
. obtain copies from Information Handling Services, 1-800-320-4555 (ask for
. Charlene Bullock and tell her you are requesting EEOC decisions under the
. Freedom of Information Act).
