We are looking for the source and cite of the principle that:

It is just as bad to treat different things similarly as it is to treat
similar things differently.

We have tried Wexis in cases, law reviews and news item with various
attacks, and Bartlett.
The initial requester thought it might be (Oliver) Holmes or Frankfurter.
Another prof thought it might be Robert Jackson.
Wexis hints that it might be (Sherlock) Holmes or the Boston Zoning
Authority.

Any hints to steer us to the correct source?
