                       Electronic Public Access
                                  to
       Automated Information in the United States Federal Courts
                           February 1, 1994
                                   
The availability of electronic public access services to federal
court information databases is expanding rapidly. The federal
judiciary has received substantial and growing interest both
from within the federal legal community and from other interested
parties (viz., federal and state agencies, business and non-profit
organizations, the press, and the public in general) in
obtaining rapid and easier access to court information. In response, the
federal courts have introduced several innovative services permitting
the public to gain direct access to court information from outside
the courthouse. Staff members of the Administrative Office s
Technology Enhancement Office (previously part of the Innovations &
Systems Development Division of the Federal Judicial Center) with the
cooperation of various circuit, district, and bankruptcy
courts, have developed and successfully implemented over the past three
years a series of electronic services to provide the public electronic
access and dissemination of official court records. The federal
judiciary plans to complete the implementation of these services into all
automated federal courts. In addition, several courts have on
their own also developed electronic public access services. To date,
the following services are being offered:
  
  ACES (Appellate Court Electronic Services) (also known as
       Electronic Dissemination of Opinions System ((EDOS)):
ACES/EDOS is an electronic bulletin board for the rapid
dissemination of appellate court information and decisions. This service
allows public users to view and electronically transfer published
slip opinions, court oral argument calendars, court rules,
notices and reports, and press releases. This service was
initially implemented in a few circuits in 1989, and is now
available in all federal circuit courts. In addition, a few district and
bankruptcy courts are beginning to offer similar
electronic access to their published court orders, opinions, and
rules.
  
  PACER (Public Access to Court Electronic Records): PACER
       allows any user with a personal computer or word processor
to dial-in to a court computer and retrieve official
electronic case information and court dockets usually in less than a
minute. This service was initially offered in a few U.S.
District Courts in 1989, and expanded into the U.S. Courts of
Appeals and U.S. Bankruptcy Courts in early 1990. This type of
service is now offered in approximately 150 federal courts (see PACER
directory), and plans are underway to make PACER or an
equivalent service available in every circuit, district
and bankruptcy courts in the near future. User fee charges
are being instituted in many courts beginning with access to
the PACER district and bankruptcy court services (see notation
in PACER Section). Persons desiring to use this service must
first register with the appropriate clerk of court or the
federal court s registration center (see Directory for telephone
registration numbers). The district court listing
specifies whether the court is presently offering only civil dockets
or both civil and criminal dockets on PACER.
  
  VCIS (Bankruptcy Voice Case Information System): VCIS uses an
       automated voice response system to read case information
       directly from the court's database in response to
Touch-Tone telephone inquiries. First offered in a few bankruptcy
courts in 1989, the service is now operating in approximately 75
bankruptcy courts. Usage of VCIS is currently free and is
         likely to remain so.
  
  ELF (Electronic Filing): ELF is a document submission service
       that allows attorneys to use their computer to
electronically file documents with the court. Either an ASCII text file
or a WordPerfect version of a document can be submitted
electronically within specified formats; for example,
WordPerfect formatted documents must use Courier type
font. The system allows users to transmit documents using XMODEM
(Checksum), XMODEM (CRC), or YMODEM communications
protocols.
       The system is presently available in two district courts
       (Eastern District of Pennsylvania and the Western District
of Texas). Each district that uses the ELF system may impose
different restrictions on the kinds of documents that may
be submitted electronically. Law firms and agencies desiring
to use the system must file an application with the
appropriate Clerk of Court.
  
  (EDI) Electronic Data Interchange is a widely used and
       standardized method for computer exchange of business
       transactions. It permits business partners to
electronically exchange data using industry defined standards (ANSI X.12)
replacing the exchange of paper forms. Manufacturing
industries typically use EDI to exchange requests for
purchase orders and invoices; the IRS uses EDI for electronic
filing of tax returns. The Administrative Office of the U.S. Courts
is planning to initially test the use of EDI to exchange
bankruptcy notices and claims with major creditors. Those
interested in a copy of Proposed Standard Transactions for Court Notices
and Bankruptcy Claims using Electronic Data Interchange (EDI)
should contact Rich Goldschmidt (202) 273-2746. This
document presents an annotated draft of standard EDI transactions
for exchanging notices and claims information.
  
In response to an increasing number of calls from court personnel
and others interested in gaining direct access to court
information, we
have prepared the attached directory about currently available
public access services. Public access services provide the
greatest benefits to the public and to the court only if they are widely
known.
Therefore, please ensure that your organization takes every
opportunity to make potential end-users aware of the
availability of these time-saving services. Those interested in the
availability of a service in a specific court or in obtaining information
brochures or instructional pamphlets about a particular service should
directly contact the court.
